Please read these Terms of Service carefully before using the Mutate Skincare website or placing an order. By accessing this website or making a purchase, you agree to be bound by these terms.

1. Acceptance of Terms

These Terms of Service ('Terms') constitute a legally binding agreement between you ('Customer', 'you', or 'your') and InHerAura Skincare Private Limited, operating under the brand name Mutate Skincare, a company incorporated under the Companies Act, 2013, with its registered office at Suncity Avenue, Shop No. 35, Sector 102, Gurugram, Haryana - 122505, India.

By visiting our website, creating an account, or placing an order, you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy, Cancellation & Refund Policy, and other applicable policies incorporated herein by reference.

If you do not agree to these Terms, please do not use our website or place an order.

2. Eligibility

To place an order on this website, you must:

• Be at least 18 years of age
• Be legally capable of entering into a binding contract under the Indian Contract Act, 1872
• Provide accurate, complete, and current information at the time of purchase
• Not be purchasing products for the purpose of resale without prior written authorisation from Mutate Skincare

By placing an order, you represent and warrant that you meet all of the above eligibility requirements.

3. Product Information

All Mutate Skincare products are cosmetic formulations intended for topical, external use on the skin. Product descriptions, ingredient lists, and images are provided for informational purposes and are as accurate as possible at the time of publication.

We reserve the right to modify formulations, packaging, or product descriptions without prior notice. Product images on our website may differ slightly from the actual product received due to photography, screen calibration, and design updates.

Our products are not medicines or medical devices. They are not intended to diagnose, treat, cure, or prevent any disease or medical condition. Please refer to our Medical Disclaimer and Product Disclaimer for further information.

4. Pricing

All prices displayed on our website are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST) unless stated otherwise. Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time you place the order.

In the event of a pricing error on our website, we reserve the right to cancel orders placed at the incorrect price. We will notify you promptly in such circumstances and process a full refund if payment has already been made.

5. Orders

By placing an order on our website, you are making an offer to purchase the specified products at the stated price and subject to these Terms. Your order is accepted upon our issuance of an order confirmation communication to your registered email address.

We reserve the right to decline or cancel any order at our discretion, including in cases involving suspected fraud, abuse, resale without authorisation, supply constraints, pricing errors, or any other legitimate operational reason. In such cases, we will endeavour to notify you promptly and process any applicable refund.

6. Payment Terms

Payment is due in full at the time of placing an order. We accept payment through the methods made available on our website, including credit and debit cards, UPI, net banking, and digital wallets, processed through our third-party payment partners (Razorpay and/or Cashfree).

All payment transactions are encrypted and processed securely. Mutate Skincare does not store complete card numbers, CVV codes, or UPI PINs. Any payment disputes must be raised with us in writing within 7 days of the relevant transaction.

Initiating a chargeback or payment dispute without first contacting our customer support team to resolve the matter is a breach of these Terms. We reserve the right to contest any chargebacks raised in bad faith.

7. Cancellation Policy

Orders may be cancelled only before they are dispatched from our facility. Once an order has been dispatched, it cannot be cancelled, and the standard return and refund policy applies.

Cancellations are processed subject to order status at the time of the request. Refunds for approved cancellations will be credited to the original payment method within 5-7 business days.

8. Shipping & Delivery

Mutate Skincare ships across India via third-party logistics providers. Delivery timelines are estimates only and are not guaranteed. We are not responsible for delays caused by courier partners, weather events, natural disasters, government restrictions, strikes, or other circumstances beyond our reasonable control.

Risk of loss and title for products pass to you upon successful delivery to the address specified in your order. Please ensure your delivery address is accurate and complete - we are not liable for non-delivery or misdelivery due to incorrect address information provided by you.

9. Returns & Exchanges

Due to the nature of cosmetic and skincare products, we do not accept returns or exchanges except in cases of confirmed damage, manufacturing defects, missing items, or incorrect products received.

All claims must be raised within 48 hours of delivery and must be supported by an uninterrupted unboxing video as described in our Cancellation & Refund Policy. We do not process claims raised after the 48-hour window under any circumstances.

10. Refunds

Approved refunds will be credited to the original payment instrument used at the time of purchase within 5-7 business days from the date of approval. The time taken for funds to reflect in your account may vary depending on your bank or payment provider.

Refunds will not be issued for products that have been used, partially consumed, or are returned without the required unboxing video evidence. We reserve the right to decline any refund request that does not meet the conditions set out in these Terms and our Cancellation & Refund Policy.

11. Intellectual Property

All content on the Mutate Skincare website, including but not limited to text, images, product photography, brand identity, logos, formulation descriptions, editorial copy, design elements, and the overall look and feel of the website, is the property of InHerAura Skincare Private Limited and is protected under applicable Indian intellectual property law.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any content from our website without our prior written permission. Any unauthorised use of our intellectual property may result in legal action.

12. Acceptable Use

By using our website, you agree not to:

• Submit false, fraudulent, or misleading information in connection with any order or claim
• Purchase products for the purpose of commercial resale without our prior written authorisation
• Use our website for any unlawful purpose or in violation of any applicable law or regulation
• Attempt to gain unauthorised access to our systems, servers, or databases
• Use automated bots, scrapers, crawlers, or other automated means to access or collect data from our website
• Interfere with or disrupt the integrity or performance of our website or its underlying infrastructure
• Engage in any conduct that could harm the reputation or commercial interests of Mutate Skincare
• Impersonate any person or entity or misrepresent your affiliation with any person or entity

Violation of these acceptable use standards may result in immediate termination of your account, cancellation of any pending orders, and/or legal action as appropriate.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Mutate Skincare, its directors, employees, agents, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, personal injury, or property damage arising out of or in connection with your use of our website or products, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of our website or products shall not exceed the total amount paid by you for the specific order giving rise to the claim.

Nothing in these Terms excludes or limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

14. Indemnification

You agree to indemnify, defend, and hold harmless InHerAura Skincare Private Limited and its officers, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of our website; (b) your breach of these Terms; (c) your violation of any applicable law or the rights of any third party; or (d) any fraudulent or bad-faith claim submitted by you.

15. Force Majeure

We shall not be held liable for any delay or failure to perform our obligations under these Terms where such delay or failure arises from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government-imposed restrictions, strikes, industrial action, civil unrest, power outages, or failure of third-party service providers.

In such circumstances, we will notify you as soon as practicable and will resume performance as soon as the event of force majeure has ceased.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts of Gurugram, Haryana, India.

17. Jurisdiction & Dispute Resolution

You irrevocably submit to the exclusive jurisdiction of the competent courts located in Gurugram, Haryana, India for the resolution of any dispute arising under or in connection with these Terms.
